do you need a dive flag when lobstering off of a kayak ?

I guess that would depend on if you were bully netting or scuba / snorkeling for lobster. Anytime you are in the water swimming and looking for lobster whether from a boat, kayak, or even shore, you are required to have a dive flag. There are two different size requirements for dive flags based on if you are displaying it from a boat or a buoy.
According to Florida Fish and Wildlife Conservation Commission http://myfwc.com/boating/regulations/#nogo
"The size of divers-down flags displayed on vessels must be at least 20 inches by 24 inches, and a stiffener is required to keep the flag unfurled. Dive flags carried on floats must be at least 12 inches by 12 inches. Also, divers-down flags on vessels must be displayed above the vessel's highest point so that the flag's visibility is not obstructed in any direction."

On the other hand if you were just bully netting lobster from the kayak or paddle board, you wouldn't be required to have a dive flag.
Another point to remember, is that the flag should only be displayed when a diver is physically in the water.
